These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. Cancelling goods and services

PLEASE NOTE: Returning of goods must be returned in an unsold condition, failure to to do this would result in a restocking charge or refusal of refund.
The Consumer Contracts Regulations also give you key cancellation rights when you enter into contracts at a distance over the phone, online, from a catalogue or face-to-face with someone who has visited your home, for instance These cancellation rights are more generous than if you bought goods or services from a high street shop. For details on your rights when you buy from a high street shop please read the Consumer Rights Act.

 

Your right to cancel

Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.
If your order consists of multiple goods, the 14 day period runs from when you get the last of the batch.
This 14 day period is the time you have to decide whether to cancel, you then have a further 14 days to actually send the goods back.

 

Your right to a refund

You should get a refund within 14 days of either the trader getting the goods back, or you providing evidence of having returned the goods (for example, a proof of postage receipt from the post office), whichever is the sooner.
If you choose to return the product it must be returned in it's original packaging and in a re-sellable condition. If it is not then Joan Allen hold the right to refuse the return or issue a refund. 
If the retailer has offered to collect the goods, it should refund you 14 days from the date you informed it you wanted to cancel the contract. So, this means you don't have to wait for the retailer to have collected the goods to get your refund.
A deduction can be made if the value of the goods has been reduced as a result of you handling the goods more than was necessary.
The extent to which you can handle the goods is the same as it would be if you were assessing them in a shop.
Refunds are only allowed back to the original payment method or in the form of a credit note for the Joan Allen shop (in store and online). eg. if you purchased the item in store and paid cash then you will be refunded in cash, if you paid online then you will be refunded online. 

 

Refunding the cost of delivery

The trader has to refund the basic delivery cost of getting the goods to you in the first place, so if you opted for enhanced service e.g. guaranteed next day, it only has to refund the basic cost.

 

Exemptions

There are some circumstances where the Consumer Contracts Regulations won’t give you a right to cancel.
These include, CDs, DVDs or software if you've broken the seal on the wrapping, perishable items and tailor-made or personalised items. They also include goods with a seal for health protection and hygiene reasons that's been broken.

 

Pre-ticked boxes

The Regulations make it clear that a trader won’t be able to charge a consumer for an item where it was selected for the consumer as part of that purchasing process, rather than the consumer actively choosing to add it to their basket.
For example, retailers are not allowed to charge for an extended warranty if it was added into your basket as a result of a pre-ticked box.
If a company does charge you in this way, you are entitled to your money back.

 

Delivery of goods

The Consumer Rights Act, which came into force on 1 October 2015, says the retailer is responsible for the condition of the goods until the goods are received by you, or by someone else you have nominated to receive them on your behalf such as a neighbour.
This means that the retailer is liable for the services provided by the couriers it employs - the delivery firm is not liable.
There is a default delivery period of 30 days during which the retailer needs to deliver the goods to you unless a longer period has been agreed.
If your delivery is later than agreed and it was essential that it was delivered on time, then you have the right to cancel the purchase and get a full refund.
If the delivery isn’t time essential but another reasonable delivery time can’t be agreed, you’re also within your right to cancel the order for a full refund.

 

Returning faulty goods

If you receive faulty goods and wish to return them, the Regulations are in addition to your other legal rights.
So, if your goods are faulty and don’t do what they're supposed to, or don’t match the description given, you have the same consumer rights under the Consumer Rights Act (which replaces the Sale of Goods Act from 1 October 2015) as you have when buying in store.
Any terms and conditions that say you must cover the cost of returning an item wouldn’t apply where the goods being returned are faulty.

 

VAT

Product prices include VAT unless otherwise stated.

UK Returns policy

Returns

You can, within 14 calendar days of receiving a Product ordered from www.joanallen.co.uk return the item to us if you wish to.
Once you decide to return the Product must be returned to us unused and in the same state that it was sold to you. Please note, any labels or tags must remain intact and the product(s) should be returned in or with its original packaging.

 

Returning products by post

Please note: This is only applicable to online purchases.
If you wish to return an online purchase via post, please follow the instructions outlined below. Please note we do not offer pre-paid postal returns.

Ensure the product(s) is in a securely wrapped parcel.

When do I get refund once I have returned an item?
Please allow at least 10-15 working days from posting the product back to us for the refund to reach your account (this may take longer depending on how long it takes your bank/building society to process the refund payment). You will be refunded the amount you paid for the product returned excluding any delivery charges (if appropriate).

 

Voucher, promotion and discount codes

If you with to return a product that has been purchased with a discount code applied to that order, you will only be refunded the discounted amount. Even if the product is no longer on offer. You will only be refunded the amount you paid for the item. 

 

Cancellation rights for EU customers

You are entitled to cancel your contract with us as follows, regardless of whether the Product is damaged or incorrectly supplied: 

You may cancel a contract at any time within 7 calendar days without any penalty and without any reason; beginning on the day after you received the Product. In this case, you will receive a full refund of the price paid for the product in accordance with our Returns Policy. 

To cancel a contract, you must contact us within the 7 calendar days from when you are in receipt of your order with an attached proof of returns postage (to confirm that the product/s has been returned within the stated time). You must contact us before returning any items to discuss logistics for the return to come back to us. 

Joan Allen will refund the price of the product in full, including the cost of sending the item to you. However, you will be responsible for the cost of returning the item to us.
